SMSF and Commercial Property: What Australian Investors Need to Know

Self-managed superannuation funds have become one of the most powerful tools available to Australian investors building long-term wealth. And within that, one of the least understood — but most valuable — strategies is using an SMSF to purchase commercial property. Done correctly, it can dramatically accelerate the growth of your retirement savings while providing real, tangible benefits right now.

But the rules are strict, the structures are specific, and the consequences of getting it wrong can be severe. Here’s what every Australian investor with a self-managed fund needs to understand.

What the Rules Actually Allow

Under current superannuation legislation, an SMSF can borrow to purchase assets — including property — through a structure called a Limited Recourse Borrowing Arrangement (LRBA). For commercial property, this is a well-established, ATO-approved pathway.

The critical distinction is between commercial and residential property. New residential property purchased with borrowed funds inside an SMSF is now heavily restricted. Commercial property, however, remains open — and it offers advantages that residential investment simply cannot match.

The Business Real Property Opportunity

The most compelling use case for SMSF commercial property is also the most commonly overlooked: purchasing the premises your own business operates from.

If you run a business — whether that’s a medical practice, a trade business, a retail operation, or a professional services firm — your SMSF is permitted to purchase the premises and lease it back to your business at arm’s length commercial rates. The rent your business pays goes directly into your super fund as concessionally taxed income. You’re essentially paying rent to yourself — into a low-tax structure — rather than to a commercial landlord.
Over the course of a ten to fifteen year mortgage, the wealth transfer this creates is significant.

How the Tax Treatment Works

Income earned within a superannuation fund is taxed at just 15% during the accumulation phase, and at zero percent during the pension phase. Compare that to the top marginal personal tax rate of 47% and the advantage becomes obvious.
When your SMSF holds a commercial property paying rent, that income is taxed at 15%. If the property is held long enough to be sold in the pension phase, the capital gain can be entirely tax free. For investors who have spent decades paying personal income tax rates on their earnings, the contrast is stark.

What You Need in Place

An SMSF commercial property purchase through an LRBA requires specific structures to be set up correctly. The bare trust, which holds the property as security for the loan until it’s paid off, must be established properly. The loan must be with an approved lender on arm’s length terms. The fund must meet minimum balance thresholds — generally, lenders want to see at least $200,000 in the fund before they’ll lend.

The SMSF trust deed must also explicitly allow for borrowing. Many older deeds don’t. This is a detail that trips up investors who assume their existing fund is ready to go.

Common Pitfalls

The ATO audits SMSF commercial property transactions carefully. Related party transactions — purchasing from someone connected to the fund — are permitted in some circumstances but subject to strict rules. Rent must be genuinely arm’s length, which means it needs to be benchmarked to the market and reviewed regularly.

A property that is used for personal benefit rather than genuine investment will attract serious penalties. The sole purpose test is non-negotiable.

Is It Right for Your Situation?

SMSF commercial property works best for business owners who have a reasonably well-funded super account, a stable business with genuine premises needs, and a ten-year-plus investment horizon. It is not a short-term play. But for the right investor in the right situation, it can be one of the most efficient wealth-building strategies available anywhere in the Australian financial landscape.
